AstraZeneca is facing a record $7 billion (£4.4 billion) settlement in a legal dispute over the drug's use, which affects about a third of patients worldwide.

The drug, known generically as sildenafil, is a common treatment for erectile dysfunction, but the company is facing a challenge from pharmaceutical giant Pfizer over its marketing of its cholesterol-lowering drug.

Pfizer, the world's largest drug maker, is seeking to block a settlement in the case brought by the U. S. government over the company's marketing of Viagra Connect, marketed under the brand name Revatio.

The suit, filed in the U. District Court for the District of New Jersey, alleged that Pfizer, which produces the drug, has engaged in "promoting and promoting deceptive practices" by offering patients a drug without their knowledge, without the knowledge of the FDA, and that those conduct "have a direct and proximate relationship to the drug's clinical use."

The suit also alleges that the company's marketing of sildenafil, which is sold under the brand name Revatio, has caused patients with heart failure to stop taking the drug for a number of years.

The complaint alleges that Pfizer's marketing of Viagra and the related erectile dysfunction drugs, such as Revatio and Cialis, "have intentionally and unfairly marketed and promoted the drug for the benefit of patients who have not been adequately informed about the risks and potential side effects associated with the drug."

The suit seeks to recover damages that may have been "loss, expense and indirect" for the health care system.

The plaintiffs allege that Viagra Connect "has failed to adequately warn about the adverse cardiovascular effects of sildenafil and for that reason has caused patients to continue taking it for many years."

In their complaint, plaintiffs claim that Pfizer "has engaged in the following illegal and deceptive acts with respect to the promotion and dissemination of sildenafil," and that "the company has been marketing and selling sildenafil without the knowledge, permission or consent of the FDA:

i) Responding to a request for an order to the FDA for approval of sildenafil as a treatment for erectile dysfunction;

ii) Marketing or offering to market sildenafil without the FDA's knowledge, permission or consent;

iii) Responding to a request for an order to the FDA to determine whether sildenafil is approved for the treatment of erectile dysfunction;

iv) Marketing or offering to market sildenafil without the FDA's knowledge, permission or consent; and

v) Responding to a request for an order to the FDA to identify the specific source of sildenafil that is likely to cause serious adverse cardiovascular effects.

The plaintiffs also claim that Pfizer "has been illegally misleading and misleadingly marketed sildenafil and the related erectile dysfunction drugs, particularly Revatio and Cialis."

The plaintiffs argue that since the plaintiffs' complaint alleges that the FDA has deliberately marketed sildenafil for a purpose other than the purpose of its marketing and promotion, the defendants "have committed an intentional and unfair deception and subversion of the public into believing that the drug is safe and effective for the treatment of erectile dysfunction."

The plaintiffs' counsel, John Lechleiter, said the company was "unable to establish a connection between its marketing of sildenafil and any conduct, conduct or acts of the defendants which were the result of the defendant's false and misleading conduct."

The plaintiffs said that the company's drug marketing practices were "unnecessary and unfair to the health care system" and that "it has not been informed of the risk factors and the potential side effects associated with sildenafil."

The plaintiffs further alleged that the defendants "have intentionally and unfairly promoted the drug for the purpose of misleading consumers and misleading the FDA and the public about its safety and efficacy."

The defendants were seeking an injunction against the government for their actions.

The suit has been settled.

The case has been transferred to the U. District Court for the District of New Jersey.
